Decision №326 of the Cabinet of Ministers dated 13 October 2015 on the revocation of its Decision №154 dated 4 October 2007 on the approval of the “Regulations for the suspension of construction work by the State Agency for Control over Construction Safety of the Ministry of Emergency Situations of the Republic of Azerbaijan” was misinterpreted by some media outlets as cancellation of the authorities of the Ministry of Emergency Situation in the construction sector.

The Cabinet of Ministers passed this decision in order to ensure the implementation of Paragraph 2.2 of Decree №533 of the Azerbaijani President dated 22 May 2015 on the approval of the “Regulations for the suspension of construction work”. The Regulations, developed in accordance with the requirements of the Urban Planning and Construction Code of the Republic of Azerbaijan, regulate procedures and mechanism of timely prevention and elimination of irregularities during construction, reconstruction and restoration work in the territory of the Republic of Azerbaijan and of the suspension of construction work in cases envisaged in the Code. It also defines the authorities of Azerbaijan’s Ministry of Emergency Situations in this sphere.

The “Regulations for the suspension of construction work” was approved under Decree №533 of the Azerbaijani President dated 22 May 2015 on the approval of the “Regulations for the suspension of construction work”. The Regulations, developed in accordance with the requirements of the Urban Planning and Construction Code of the Republic of Azerbaijan, regulate procedures and mechanisms of timely prevention and elimination of irregularities during construction, reconstruction and restoration activities in the territory of the Republic of Azerbaijan and of the suspension of construction work in cases envisaged in the Code. It also defines the authorities of Azerbaijan’s Ministry of Emergency Situations in this sphere. Under the Regulations, the provisions on the suspension of construction work have been improved and simplified for legal entities and individuals engaging in construction activities. In accordance with the Regulations, the Ministry of Emergency Situations is due to implement its authorities through its State Agency for Control over Construction Safety and the Main State Construction Inspectorate of the Agency. According to the Regulations, in case any irregularities are detected in construction, an act is written with each irregularity described separately, and the customer (contractor) is given binding written instructions on the elimination of the irregularities without ceasing the construction.

According to Paragraph 2.2 of Decree №533 of the Azerbaijani President dated 22 May 2015 on the approval of the “Regulations for the suspension of construction work”, the Cabinet of Ministers is due to ensure its regulatory and legal acts are adjusted to the Decree and inform the Azerbaijani President about them. In other words, the Cabinet of Ministers in connection with the execution of this paragraph has abolished the “Regulations for the suspension of construction work by the State Agency for Control over Construction Safety of the Ministry of Emergency Situations of the Republic of Azerbaijan”. That is, in connection with the new Regulations approved under the presidential Decree, the “Regulations for the suspension of construction work by the State Agency for Control over Construction Safety of the Ministry of Emergency Situations of the Republic of Azerbaijan” were cancelled.
